These General Terms and Conditions of Sale are concluded between the company CASUAL (hereinafter "the Company") and any person making a purchase (hereinafter "the Customer") on the site www.boa-fightwear.fr (hereinafter referred to as "the Site").
All orders placed through the Site are subject without reservation to these General Terms and Conditions of Sale, the latter representing the entirety of the reciprocal commitments of the Company and the Customer who expressly accepts them.
Orders may only be placed by adults.
The company CASUAL reserves the right to modify these general conditions of sale at any time, subject to displaying these modifications on its site.

The Company provides the Customer with a customer service available from Monday to Friday from 9:00 a.m. to 12:00 p.m. and from 2:00 p.m. to 6:00 p.m. by telephone at +33982507665 or by WhatsApp at +33663652639 as well as assistance via online chat or by email at contact@boa-fightwear.fr



Article n°3: Products marketed

The Customer may select one or more products from the different categories offered on the Site.
In accordance with the provisions of Article L 111-1 of the Consumer Code, the Customer may, prior to ordering, read the essential characteristics of the product(s) they wish to order on the Site by going to the product sheet.
The Customer having taken note of the products and their characteristics, he has under his sole responsibility and according to his needs as he has previously determined them before any order, made his choice on the product(s) which are the subject of his order.
In addition, the Customer knowing alone the materials and others, which he uses, is the sole judge of the compatibility of the products ordered with those used by him.



Article 4: Availability of products

The offers of products and prices are valid as long as they are visible on the Site, within the limit of available stocks.
In the event of unavailability of a product after placing the order, the Company will inform the Customer as soon as possible by all the means at its disposal to contact the customer.
In accordance with the provisions of Article L121.20.3 of the Consumer Code, CASUAL may in this case provide a product of equivalent quality and price, failing which CASUAL will not make use of this option, the Customer will be reimbursed without delay and at the latest within 30 days of payment of the sums he has paid.



Article No. 5: Price

The prices displayed on the Site are exclusive of participation in processing and shipping costs and are indicated and based in Euros with the possibility of having prices in Pound, Krona, Ruble and US-Dollar conversion, all taxes included.
VAT is applied at the rates in effect at the time the order is placed.
In the event of an order to a country other than mainland France, the Customer is the importer of the product(s) concerned.
For all products shipped outside the European Union and DOM TOM, the price will be calculated excluding taxes automatically on the invoice, customs duties or other local taxes or import duties or state taxes may be payable, these duties and sums are not the responsibility of the Company, they will be the responsibility of the Customer and are the sole responsibility, both in terms of declarations and payments, of the authorities and/or competent bodies of the country of shipment.
The Customer must inquire about these aspects, before any order with CASUAL, with their local authorities. All orders regardless of their origin are payable in Euros.
The Company reserves the right to modify its prices at any time but undertakes to apply the rates in force when the order is registered, subject to the availability of the products on that date.
In the event of promotional offers, the prices indicated will be valid during the period of the offer.



Article No. 6: Order

The customer has 2 ordering options, ordering via an Amazon account and standard ordering with the creation of a profile.
Any order on the Site implies immediate and unreserved acceptance of these General Terms and Conditions of Sale, without this acceptance being conditioned by a handwritten signature on the part of the Customer.
From the moment the Customer has registered his order and validated it, he is considered to have knowingly and unreservedly accepted these General Terms and Conditions of Sale, the prices, volumes and quantities of the products offered for sale and ordered.
Any order requires the creation of a customer account which gives access to his customer area which is done using his email address indicated when creating the account as well as the secret and personal password chosen.
The Company cannot be held responsible for any action carried out on the customer area by a third party to whom the Customer has communicated their identifiers or who has had access to the account following negligence on the part of the Customer.
All information relating to the order will be available in the "history and details of my orders" section of the customer area.
The Customer undertakes to ensure that the information communicated when ordering is complete, accurate and up to date. Otherwise, the Company reserves the right to cancel the order outright.
The order may be placed for a delivery address different from the billing address.
Following receipt of the order, the Company will send the Customer an order confirmation email including the order summary and its number, then will definitively validate the order by sending an order validation email.
These emails will be sent to the email address provided when creating the customer account.
The Company reserves the right to refuse or cancel an order if it considers that the Customer is engaged in distribution or carrying out an economic activity using the products thus ordered without a prior commercial agreement with the company Casual.



Article No. 7: Payment

All orders are payable in Euros.
Payment of the full price is due immediately on the date of the order. At no time may the amounts paid be considered as deposits or down payments.
The Company will collect the full amount of the order at the time of dispatch of the order, unless otherwise specified on the article page.
To pay for their order, the Customer has all the means of payment referred to in the order form: bank card (Carte Bleue, Mastercard, Visa, American Express), SEPA transfer, PayPal, Apple Pay, Amazon Pay.
The Customer guarantees to the Company that he has the authorizations that may be necessary to use the payment method he has chosen, when registering the order form.
The Company reserves the right to request a photocopy of the Customer's identity card for any payment and to suspend or cancel any order and/or delivery, regardless of their nature and level of execution, in the event of non-payment of any amount that would be due by the Customer, or in the event of a payment incident.
As part of the fight against Internet fraud, information relating to any order may be transmitted to any third party for verification.
In the particular case of pre-ordered items, the Customer's card may be debited up to three days before the order is shipped.



Article No. 8: Payment security

The Site is subject to a security system, fully encrypted and protected. The protocol used is SSL coupled with bank electronic payment.
This means that:
- the information related to the order and the bank card number do not circulate in clear text on the Internet.
- the bank card number is not printed on any paper, invoice, receipt or other listing.
- the merchant does not have knowledge of the card numbers.
- our service providers do not keep the card numbers after having transmitted the payment transaction to the merchant's bank.

Thus, no person has access, either electronically or in printed form, to the bank card details of buyers.
By providing his bank details, the Customer accepts in advance and unconditionally that the Company will proceed with the secure transaction and therefore debit his account upon seeing the statements sent by the Company, even in the absence of invoices signed by the cardholder. The authorization to debit the Customer account is always given for the amount of the product purchased as invoiced by the Company.



Article No. 9: Reservation of ownership and transfer of risks

The products remain the property of the Company until full payment of the price by the Customer. However, the risks will be transferred to the Customer upon receipt of the order.



Article No. 10: Delivery and receipt

All deadlines announced on the Site are calculated in working days.
Unless otherwise specified, delivery is made to the address that the Customer indicated when ordering.
In the event of partial availability of the items, the Company may be required to split the orders, so that the available items can be sent first, the balance of the order will be sent when all the other items are available.

The preparation and shipping process

After receiving the order, the preparation time is 24 hours (excluding weekends and public holidays).
We ship throughout Europe and the rest of the world .

How to track your package

As soon as the order is shipped from our warehouse, we send an email confirming the shipment of the package.
To track an order, simply log on to the carrier's website to see the delivery of the package in real time.

The precautionary principle

Failure to comply with the procedures set out below will result in no complaints from the Customer being accepted.
The Customer must check the apparent condition of the package and products upon delivery.
The Customer must indicate, in handwritten form on the delivery note or the document justifying taking possession of the order, any anomaly noted. This check is considered to have been carried out once the delivery note has been signed.
In the event that the Customer has any doubts of any nature whatsoever about the contents of his package, he is required:
- to apply the procedure (in particular to report any damage, all claims and reservations) and to refuse the goods by immediately issuing a report of anomaly to the Post Office employee.
- to report these incidents to the Company.



Article No. 11: Return and Refund

Return Deadlines

In accordance with Article L121-20-12 of the Consumer Code, the Customer has a period of 14 days from the date of receipt of his order.
When the 14-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

Return conditions

For your request to be validated, the products must not be worn* but must be returned in their original packaging, in perfect condition and carefully folded (not in a ball).
If the return or exchange is due to an original defect of the item or any error on the part of the company or the warehouse, the costs incurred for the return and the new shipment will be at our expense.
*Items tried on to check the size are not considered worn but we reserve the right to refuse a return if it is damaged or for reasons of hygiene.
*We consider as worn, a product used, put to training and/or machine.

By re-crediting the bank card entered during the initial order or, if not possible, by bank transfer or by the allocation of a voucher, under the conditions stated.



Article n°12: Guarantees and liability

All products sold by the Company are guaranteed, in the event of a defect, for 14 days from the date of delivery or collection of the product under normal conditions of use.
The warranty is limited to the exchange of the product or its repair, subject to providing proof of payment, the invoice and after verification of the product by the Company.
The warranty does not cover deterioration due to negligence, misuse or poor maintenance.
This warranty does not exclude the legal warranty for hidden defects as it results from the legal provisions.
The Company cannot be held responsible and no compensation may be requested from it for delays in delivery or harmful consequences due to cases of force majeure as defined by the case law of the French courts and tribunals.
The Company shall not be held liable for interruptions, delays or unavailability of the Site due to maintenance work, Internet network interruptions, technical breakdowns, force majeure, the actions of a third party or any other circumstance whatsoever.
The Company shall endeavour to ensure, to the best of its ability, the accuracy and updating of the information published on the Site, the content of which it reserves the right to correct at any time and without notice.

If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, regulation or following a final decision by a competent court, the other provisions shall retain their full force and scope
